Freedom Of Speech

Ok guys and gals, there has been a story ive been following for a couple of days now and it seems with recent events regarding that story i thought id show it to you if you have not already seen it.

To sum up, this woman went on a company trip to Arlington Cemetery and decided it was a grand idea to take a photo of herself pretending to scream and giving the finger in front of a sign reading "Silence and Respect". Now the debate has started on whether or not this is considered to be free speech. The funny part about the debate is the people who side with this being free speech claim nothing should happen to her. They are also telling the people who are upset that they should drop it and not say anything, which seems to be the very definition of "hypocrite". Im sure most could guess where i stand on this. I, like many other on this site, swore at one time or another to defend the constitution of the United States. In doing so its my duty to defend the rights of people like this to disrespect me. While that bothers me, it doesn't hold a candle to a person disrespecting someone who has died defending that constitution.

In the end i feel she should be found guilty of a crime because it is actually illegal to do things like this at Arlington:


32 CFR 553.22 - Visitors' rules for the Arlington National Cemetery.
(13) Engage in any disorderly conduct within the Cemetery grounds. For purposes of this section, a person shall be guilty of disorderly conduct if, with purpose to cause, or with knowledge that he is likely to cause, public inconvenience, annoyance or alarm, he:
(i) Engages in, promotes, instigates, encourages, or aids and abets fighting, or threatening, violent or tumultuous behavior;
(ii) Yells, utters loud and boisterous language or makes other unreasonably loud noise;
(iii) Interrupts or disturbs a memorial service or ceremony;
(iv) Utters to any person present abusive, insulting, profane, indecent or otherwise provocative language or gesture that by its very utterance tends to incite an immediate breach of the peace;
(v) Obstructs movement on the streets, sidewalks, or pathways of the Cemetery grounds without prior authorization by competent authority;
(vi) Disobeys a proper request or order by the Superintendent, Cemetery special police, park police, or other competent authority to disperse or to leave the Cemetery grounds; or
(vii) Otherwise creates a hazardous or physically offensive condition by any act not authorized by competent authority.

Unfortunetely I dont see any "laws" that she has broken - she never actually yelled, or created a loud noise. Nor directed her profane finger at anyone. I believe this is completely disrespectful, and she should be shamed for her actions.. But legally speaking, I dont see much of a case against her.

Days like today make we wish people like her lived in the 1800's ... things were dealt with differently back then

I'm with ya Ryan. Totally disrespectful for her to do something like that, joking or not, at a place where people of this great country have died just so she could do something like that. I think she should be sentenced to go volunteer at the Walter Reed Hospital for a week.

This is where the law shouldn't have to intervene, but someone present should have punched her in the face.

We don't need the gov to babysit or for the police to make sure people do the right thing, some things can be handled on the spot by responsible human beings.

Legally speaking or not what she did was wrong. I'm in the Honor Guard and spend A LOT of time in Arlington Cemetery as a body bearer. There are a different set of rules there period. Fine her, ban her I don't care but some action I feel needs to be taken. This is totally unexceptable and disrespectful to those who have lost their lives and their families. This is very personal to me obviously bc of what I do and really strikes a nerve to say the least.

Just got back from Bethesda/Walter reed hospital and just saw this, and I think I might have busted a vessel in my head from being so pissed. Its unbelievable how the civilian population talks about their rights and freedoms with no comprehension that it has been paid for with the blood of young men/women. I have lost way to many brothers to tolerate this kind of behavior and god help anyone that would try to disrespect them in their resting place. If I had been there I prolly would have taken it into my own hands with nasty ending. Freedom should not be extended to people like this, I consider it to be the same as treason.

I am not American, and I doubt legal action could be taken but for people to use freedom of speech as a defence to action that directly disrespect the people that fought and died so that we all ( Canadian included) HAVE the freedom of speech, is a moral crime! The ***** should be forced to serve!

You don't see someone walking all over your family's burial grounds causing a disturbance do you? If you did would you take it lightly? I know I wouldn't

That's just disrespectful to the men and women who have given their lives for this country and our freedoms. Some people need to learn that there's a time and place for things like that, Arlington Natl is not the place for that, it's a place to remember those we've lost and what they did for us...not to goof around, shame on you. I'm the biggest jokester you'll ever meet, but would never go that far, not in a million years
