so not to brag a bit here but i dont drive my rig everyday and it is in perfect condition at only about 7 months old. I keep it garaged, and it does not come out in rain snow or cloudy weather.(ok mybee when its partly cloudy)lol so its all waxed up and lookin sexy as all hell. Almost as sexy as my fiance. So i take it to go to a locall car show in eastchester ny today and was gonna enetr it since it was the only jeep there i fig i deff would have won something. I got there a tad late and the lot is full and they could not let me in so they tell me to park in the next lot. I say no problem. I am in the lot looking for a spot. Now i get behind a honda accord and he thought someone was getting out and they werent. Well he decides to back up to find another spot.do you think he looks behind him before he backs up?? No ofcourse not. *******!!! Backs right into me. Wellll needless to say i flip my effin **** on this guy bigtime. Not just because he hit me but because he didnt even turn his head to look back. What if there was a small kid behind him? Or anyone on foot for that matter!! Soo first thing i do is call the cops for the paperwork. He admits it was his fault but now i have a doce crack in my front facia. He only hit my going about 4 or 5 miles an hour tops. There is no damage to anything but the facia. The inserts are perfect as well as the chome insert. Soo i tell him that he or his insurence is paying and that all work will get done by my jeep dealer.. Can someone give me some advice on how i approach this tomorrow morning?? Do i call my dealer and tell them what happen and have him fax his info to them or what????

Same thing happened to my girlfriend a few months ago. Girl went to backup instead of pulling out of the complex while at a stop sign, didnt look behind and smash her front end up good. Damage didn't look too bad but it cost about $5,000 to fix. Call you insurance company and report the incident. An adjuster from the persons insurance company will come out and assess the damage. They will then usually cut you a check at which time you can take the car anywhere you choose to have it repaired.

Since this was in a parking lot, his insurance doesn't cover it. Is that correct? I think that is the case since parking lots are considered "off-road" or "private property". So if that is true, then he'll have to pay cash and there is no law forcing him to pay.

Yes, I'd call your dealer... set up a time to bring it in to get the quote to fix it... and I believe you give them the insurance info of the other guy. Or if he is paying out of pocket, get the quote and then contact the guy to get a check from him first before getting the work done.

sorry to hear about the bone head accident. I had a girl ram the side of my lil beater truck a few months back... she flew across the parking lot (which had many low, young trees blocking the view) and we were on the actual 'road' with the right of way...she ran into my rear tire (and I have mud tires and a small lift on the truck) and it jacked up her front bumper and ripped off the license plate...haha... I have a scuff on my tire and that was it. But if I was in the jeep, it would of been ugly.

Never heard of this before. I've been hit in a parking lot 2 times while driving and 1 time while in a store and parked. Insurance always covered everything. My friend got hit in one of our friends driveway during a party. We didn't know the guy but his insurance covered it.

I was unaware of that as well.... I thought any accident should be covered by the insurance of the person at fault. But I'm no expert on the loop holes in insurance claims.

Go to the dealership tomorrow and have them look at it. They will obviously repair as much as they can because they want to make money. Show them anything that you want repaired and have them bill the insurance. Its not that big of a deal but I feel your frustration about the whole situation. Sorry it had to happen, but just get it fixed and try to forget about it.

i dont want my insurance involved, so would he have to call his insurence to come out? also i told him i am not having it repaired he will have to get a whole new piece..

Your insurance shouldnt need to be involved. If you have his insurance info, call them and they need to come look at the damage. You can have the quote to repair it in hand to show them when they come to see it.

If other guys insurance company is involved then they are required to contact his insurance company. If the other guys insurance company does not get involved then his insurance won't know unless he reports it.

No he definitly has to pay now as far as a ticket that is because he is on private property so he mite not get one.

Since the damage seems to be minimal his insurance will probably want to pay to fix the damaged pieces instead of replace them. Of course this should not be acceptable to you so you may have to get your insurance involved to handle this. When I was hit and the rear bumper and exhaust was damaged the at fault person's insurance would only pay to repair. I ended up calling my insurance who dealt with their insurance and was able to get the money needed to cover the replacement. Hope you have better luck but if it comes to it remember that is what insurance is for.

thanks squilly. the adjuster is gonna call me by tues. i looked at the price of a new facia and its not bad. i dont need new inserts or chrome piece. just a new facia and install of all pieces. i would think it would be about the same but anyway like u and i said repairs dont cut it. its too new of a truck and well..... i want a new one put on!! bottom line.we will see what happens with the adjuster. ill call the dealer or stop by there and get a number from them

Police will not do a report when in a parking lot... private property.... Thus it's your responsibiltiy to get the ball rolling. Once you file a claim with your insurance with his information, the two insurance comapnies will work it out. If worst comes to worst, you should be covered by yours.

^^that depends on the policy of your local PD.

A similar story happened to me. I had detailed the rig and was ready to trade it in on a Viper during the upcoming weekend so I covered it in my garage. My wife decided to drive my car to work that day instead of taking her car. When the time came to pick up my kids I couldn't use her car since she took both keys so I took out the Jeep from the garage; one day before I had to trade it in.

I went to pick up the kids at their school and stopped by the grocery store along the way home. Some f'ing kid backed out of their parking spot and lightly tagged my drivers door.

I had the body shop replace the whole door with oem parts but now I'm sure it will show up on the carfax. Not only that but the factory stickers on the door had to be removed and reapplied to the new door, that didn't come out too nice. I still have the Jeep, no Viper.

OK sorry for the mis-information. I had always thought that parking lots being "private property" meant the cops wouldn't issue a ticket and so the insurance company couldn't establish blame. Sorry if I scared you needlessly.
