The salesman said, "I have a hang over. My head is killing me." He was driving like a mad man and got into a wreck during our test drive. The car was coming right at me from my right hand side, a crappy little white jap car, in the right front passenger side, and they were coming hard down on me. I yelled, "Watch out!", to the salesman, who could have veered left and gunned it out of the way but he panicked and froze like a deer in the head lights. He slammed on the brakes instead of taking evasive action. The white car kept coming hard.
My wife screamed, "Oh.", and the white car kept coming down on us in slow motion. My stomach started roiling and boiling. I couldn't take my eyes off it. I just watched the car keep coming straight at me. My neck was craned over my right shoulder. It was like some big white boulder rolling down a hill. I could not believe the salesman was braking our black car and not gunning it to the left and out of harm's way.
(I drive a big truck for a living, and have had to evade fools like this all my driving life. If you don't have time to check your blind spot, you veer to avoid the certain threat anyway. Odds are there is no one there to your left blind spot.) The car just kept barreling down on us and "Wham!", hit the front right side passenger wheel of the srt8. A bespectacled, over weight english woman with two kids in the white car got out and apologized. She said, "I'm sorry."
I said, "You ran a red light."
The woman who hit us ran a red light, but the salesman could have avoided the impact if he hadn't stomped on the brakes. He jumped on it as the light turned green and she barrled down on us at a ninety degree angle from my right.
The dealer lied about our trade in value of our 07 vette vert., and they didn't even offer a chiropractor visit. "We can give you $41K for the vette..", and as we drove out of the lot 1 min. later, he came out and said, " We made a couple of more calls, (in the 1 min. it took to leave), and we can give you $45k." I sold the vette for $53K on ebay two days later. (I guess I should have asked for more.) My shoulder and neck are still stiff, and my wife has a pinched nerve in her right rotator cuff. It hurt her during our morning walk today. And they tried to sell us the jeep srt8 for $48,640, $2,000 over sticker price. We only wrecked, (salesman was driving), because someone forgot the keys to the garage where the jeep was stored. (Black srt8 07). And we wrecked as he was gunning the sedan srt8 back to the shop where the keys were kept. They have four buildings in that mission district.

Yeah, well. I asked to go see a chiropractor and they looked at me with blank faces, as if no one was hurt or injured. Sort of pisses me off now that I have some distance from the charming salesmen. My wife is not happy. Her face was scrunched up in pain on the walk up the steep hill this morning, the day after the accident. Stealers always think they can charm their way out of anything, I guess. We don't have the money to hire a lawyer, and they want $5k retainer. Another case of the stealer beating down the customer, literally this time. I have the urge to post this up on all the jeep and chrysler forums I can find, just to see who emails and calls the dealer. How many tijmes you been lied to by dealers? It's their job to lie.

You may want to bring this up to Chrysler/Jeep directly. Call corporate and see if there's anything they can do for you. Another rought is to go through one of those contingency lawyers. Those that don't get paid unless you get paid.

gbusy1906 04-16-2007, 08:57 PM You may need legal advice!!!!!! The dealer definately has some legal exposure. You sound as though you made it clear you and your wife suffered some damage-inconveniences and discomforts. You may have a LIST claim-soft tissue injuries. Don't way too long. It is a shame you all were blown off by the dealer.

While I agree that it certainly doesn't hurt to get legal advice, I don't really see where the dealership will be liable. Unless you can establish that the salesman was truly driving while impaired in some manner, or he did something negligent or illegal, I think you will just have to chalk it up to bad luck and move on. I tend to doubt a hangover will be considered impairment, even if you got him to admit to the condition, and unfortunately simply being a bad driver isn't illegal. Neither is stupidty. Although both should be.
Sometimes bad things happen and there's no payback. It sucks, but that's life.
shodanusmc 04-17-2007, 06:40 AM Go see a Personal Injury attorney. They usually work on a 33% fee of the dollars collected. You also need to get your injuries documented by a Physician. The longer you wait, the worse it is for a case. A trip to the ER is in order, ASAP. Many cervical injuries do not show up until later...and by then it is too late. Good luck.
wow that is definitely a horror show. I had a similar experience in 2001 when I bought my Lightning. Dealer was hung over and actually took a break in the parking lot to vomit. Needless to say he didn't come for the test drive and gave me a killer deal. Way to be professional on the job right.

Wow. That sucks. What an ahole. True, probably better just to chalk it up and move on. I see my wife in pain and I am pissed, though. Her nerve is killing her in that shoulder. She winces and i massage her a little, and my anger is growing a bit. When I get mad i don't usually get even, but it does rankle a bit. My eyes narrow. My jaw sets. My blood pressure rises. I have 19 yr. old thoughts for a bit.

Yep. Same one. They have four buildings sprinkled throughout the mission. I been to the service building also, through urine soaked alleys, trash strewn street, needles in the gutter, defecation in the doorway, dark and dirty building. Bad hood.
