I bought my beast last year around january and in march brought her in for brake noise and they decided to replace the pads and rotors (frt) under warranty.

May returned to dealership for same problem and they checked her out, test drove her and found nothing wrong .....hmmm

June took her in to take a test drive with the service mgr.
While driving she made a little noise and the service mgr tells me "well you have high performance brakes you should expect the noise"
well needles to say if i didnt have a family to take care of i would ve choked the SOB. I told him thank you for your time and get out.

present day brought her in last night odometer reads 12200 i called and warned them i was coming in again and they said sorry your over 12k warranty for your brakes warranty. i said no no this is a problem from the onset of owning the car your going to fix it . They said in goodwill that they will fix it one more time for free, i picked her up this am guess what she still squeels they replaced frt pads and rotors, i told them how about the rears idiots never even looked at them i know for a fact the loud train type noise is coming from the rear......sorry for the length of this thread
but my question is am i in the right for a lemon law. The service advisor even tells me that some customers add aftermarket brakes.

$655 bucks will get you some good looking and performing R1 slotted and drilled rotors and aftermarket pads. But, that doesn't always fixes the squeal.

I seriously doubt you'll be able to lemon the car for brake squealing -- doesn't affect the driveability/usability of the car, just annoying . . . plus brakes I would think are considered a normal 'wear and tear' part and doubtful they could lemon it for that.

Personally I think you should consider yourself lucky you got new rotors/pads twice over the deal. Many dealers would not cover it at all considering brakes are a normal wear/tear item.

It's a known issue with these rigs that the OEM pads and rotors suck. Pretty much every owner on here has dealt with squealing brakes in one way or another. I had some squeal at just over 3k miles and fortunately the dealer was willing to resurface the rotors for me under warranty. Starting to squeal again now at 6k miles.

Try talking with the svc manager again & see if you can work something out. You can buy a set of drilled/slotted rotors and pads from R1 for around $1,000 for all 4 corners. If he's willing to replace/resurface the rotors under warranty ask if he'll just install new rotors you provide instead, it would be the same amount of labor.

For Lemon Law:

Do a google search for your state. Every state has diff laws. Most require the claim during the first 12 months of ownership. And most are 3 times for the same problem unresolved.

Good Luck

My brakes squeal at low speed, when I am backing up for instance. I so far haven't had any issues at normal speeds to date. Hope I am not tempting fate

Couple of points i like to add.
i fully understand that i can get new brake kits to resolve this problem.
What i dont understand is that chrysler has let this problem go on for soo long
does anyone know if the 06 and 07's have the same problem?

I think it sucks that the dealership knows there is a problem and is willing to work with a customer upto the 12k warranty but after that your on your own
doesnt make sense

I had a chevy tahoe limited with 20'' rims and gforce big brake kit and never had a problem with squeeling, unfortunately she shook like hell at 80 mph and had to lemon law it after nothing was done after 8 times of service calls.

Have 3600 miles on my 08 & brakes squeal like raped banshees, rain or shine. Taking it in on Friday to see what the dealership will do or say.

Also own a 2001 Cobra with aftermarket Brembo big brake kit on the fronts, only a very mild squeak in the last 5 feet of a stop. Do not understand why SRT8 setup is so damn noisy...
